Nielsen Competitor HyphaMetrics Not Guilty in Patent Infringement Case

The jury behind the Nielsen v. HyphaMetrics lawsuit reached a verdict Friday, finding HyphaMetrics not guilty of infringing on a pair of Nielsen’s patents.

Nielsen, a measurement and adtech giant, previously filed two lawsuits against HyphaMetrics, a competitor in the measurement and data space. One of the lawsuits came in February 2023, and another came later in May 2023; however, both were consolidated.

In a statement, HyphaMetrics CEO Joanna Drews said the verdict is a victory against Nielsen.

“HyphaMetrics’ historic lawsuit victory against Nielsen is a monumental win for consumers and the entire media ecosystem,” Drews said. “We are thrilled that the jury recognized Neilson’s allegations were baseless and predatory, and that HyphaMetrics’ single-source data stream is a proprietary solution that will revolutionize media measurement. The entire HyphaMetrics team is excited to move past this meritless lawsuit, so we can continue to help clients bridge the gap between streaming, linear, and digital with unified reporting.”

According to Nielsen, the measurement firm is reviewing the record and considering an appeal.

“We filed this suit because the product that HyphaMetrics marketed, promised, and said it sold is something we believed infringed Nielsen’s patents,” Nielsen said in its statement. “As the trial evolved, we were surprised to learn that HyphaMetrics has no actual product, no data for sale, and no plans to use AI-enabled content recognition technology now or in the future. We imagine that the clients who signed up for the product that HyphaMetrics marketed will be interested and surprised to learn this as well.”

Following Nielsen’s statement, HyphaMetrics’ CEO addressed the company’s claims, including assertions that HyphaMetrics has “no actual product” or data for sale.

“If their statement is honest, why didn’t Nielsen drop the lawsuit? Why consider appealing when you do not believe we have a product? It seems frivolous and disingenuous,” Drews told ADWEEK.

Over the last three years, Nielsen has filed ten patent infringement complaints against competitors like TVision, HyphaMetrics, ACRCloud, and VideoAmp. One of VideoAmp’s lawsuits was dismissed earlier this year before Nielsen swooped in with a new complaint.
